On December 13, 2017, President Obama signed the 21st Century Cures Act. It already passed in the House and the Senate. This law wants to expand medical research, invest in mental health resources, and combat prescription and opioid drug addiction problems.
The 21st Century Cures Act also contains the Special Needs Trust Fairness Act. This Act makes a simple change to current federal laws. A person with special needs can now create their special needs trusts. The previous law from 1993 required that a special needs trust be “established for the benefit of such individual by a parent, grandparent, legal guardian of the individual, or a court.”
